Terms and Conditions
ALL ORDERS SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS:
QUOTATION - All prices agreed upon via email are subject to change
depending on the nature of the work involved once it is received.
ORDERS - Acceptance of order by ErinsillArt is dependent on payment of
50% of the estimated work to be done.
CREATIVE WORK – Creative work, such as sketches, layouts,
and all preparatory work developed and furnished by ErinsillArt,
shall remain its exclusive property and no use of same shall be made,
nor any ideas obtained there from be used, until Customer has paid ErinsillArt
in full. At that time, all such work is the exclusive property of the Customer
under terms of individual terms agreed upon.
In the unlikely event that a Customer cannot accept a design submitted,
the Customer forfeits the 50% deposit (for time spent on work done)
and holds no rights to any work done to that point.
ErinsillArt shall have the right to display any creative work for the limited
purpose of demonstrating capabilities and otherwise promoting ErinsillArt
services on the Internet, unless advised otherwise by Customer.
ACCURACY OF SPECIFICATION – Prices are based on the accuracy of the
specifications provided. ErinsillArt can re-quote a job at time of submission
if any materials do not conform to the information on which the original
quotation was based.
ELECTRONIC MANUSCRIPT OR IMAGE – It is the Customer’s responsibility
to maintain a copy of the original file. ErinsillArt is not responsible for
accidental damage to media supplied by the Customer or for the
accuracy of furnished input or final output.
Until digital input can be evaluated by ErinsillArt, no claims or promises are
made about ErinsillArt's ability to work with jobs submitted in digital format, and
no liability is assumed for problems that may arise.
ALTERATIONS – Alterations represent corrections made to the Customer’s
originally supplied file at any stage of the design process.
Twenty-five (25) changes are included in base price of text layouts.
Any changes in excess of these twenty-five (25) are billable at
$5.00 per change.
Text or cover files which need to be accessed in addition to two proofs
included in base price are subject to a $15/occasion access fee,
and any work to be done in addition may be billable at $65/hour.
If corrections require submission of a new file, ErinsillArt will charge an
additional fee.
OUTSIDE PURCHASES – Unless otherwise agreed in writing, all outside
purchases as requested or authorized by the Customer, are chargeable.
POSTAGE – Unless otherwise agreed, the Customer will pay for all postage
charges.
PROOFS –Proofs shall be submitted as PDF proof via email.
Two proofs are included in base price. Corrections are to be noted to
ErinsillArt either in an email or marked on a print out of the proof that the
Customer will return at Customer’s expense.
If revised proofs are desired, request must be made when proofs are returned.
CUSTOMER’S ARTWORK/PROPERTY – ErinsillArt will return all
artwork/property to Customer or Artist or those who own rights to said work
upon completion of the project.
PRODUCTION SCHEDULES – Illustration and graphic design are creative
processes, and not manufacturing. There are many variables and therefore
design work cannot be scheduled the way a manufactured product would be,
so the scheduling information will be dictated by individual project.
TERMS/CLAIMS – Payment terms shall be whatever was set forth in the
quotation or invoice unless otherwise provided in writing.
If payment is not made, the Customer is liable for all collection costs incurred
by ErinsillArt. Claims must be made by the Customer in writing within a period
of fifteen (15) days after delivery of all or any part of the order.
Failure to make such claim within the stated period shall constitute irrevocable
acceptance and an admission that the order fully complies with terms,
conditions, and specifications.
DISCLAIMER OF IMPLIED WARRANTIES – ErinsillArt warrants only that the
work will conform to the description contained in the order.
ErinsillArt's maximum liability, whether by negligence, contract, or otherwise,
will not exceed the return of the amount invoiced for the work in dispute. Under
no circumstance will ErinsillArt be liable for specific, individual or consequential
damages.
